General conditions of sale

The present general conditions of sale (GCS) have two aims: on one hand, of informing whoever it may concern as to the conditions and modalities under which Intellectica proposes the sale and proceeds to the delivery to the client of the items ordered; and on the other hand, to define the rights and obligations of both parties in the frame of the sale of products on the site.

By filling in the command form and by ticking the slot « I accept the general conditions of sale”, it is  understood that the buyer accepts, without reserve, the General Conditions of Sale presented above, in conformity with the RGPD (the General Regulations on the Protection of Personal Data - 27/04/2016).

The client declares that he/she is of adult age, with full legal capacity to engage themselves under the GCS, or else to act under the supervision of a person having parental authority. Intellectica reserves the right to modify the GCS at any moment. Notwithstanding, the sole GCS applicable to a sale are those accepted by the client at the time of sale.

 


Products and services available

Intellectica markets several types of products and services via the site www.intellectica.org :

1. Purchase of the right of access to a particular article and to the downloading of its digital version (PDF);

2. Purchase of the right of access to a particular volume and to the downloading of its digital version (PDF) with, as an option, the purchase of this volume in paper format;

3. Purchase online of a subscription to the digital format of the journal and, as an option, to the paper format.

It is not possible to purchase a single issue or a subscription to the « paper » format without purchasing a digital access to that issue or without purchasing a digital subscription. The paper format, both for the purchase of a single issue and for the subscription, are options in addition to the digital purchase or subscription.

The rights of access to the digital version are sold on a nominal basis, to the holder of the account, for personal or professional use. They can in no case be transferred to a third party or proposed for public circulation, for example on an Internet site with free access.

When the holder of the account is an institution, the members of the latter benefit from the rights to access and downloading of the articles in the issues of the journal which have been acquired by the institution. These rights of access can in no case be transferred to persons or other parties exterior to the institution in question, or proposed for public circulation, including the public parts of the Internet site of the institution.

Purchase of right of access to an article

1 – Process for passing an order 


Every purchase of a right of access to an article and to downloading the digital version made via the site www.intellectica.org is considered definitive when the user has passed all the steps and confirmed their order.

2 – Execution of an order 


Intellectica undertakes to provide immediate access to the article for which the user has made an order. The right to consult the online version of an article is accompanied by the right to download a PDF version.
The user should note that Intellectica cannot be held responsible for any damage or for any temporary or permanent incident that may be caused to the data or digital material of the client during downloading of files from the site www.intellectica.org. In particular, Intellectica is not responsible for the eventual transmission of viruses by means of its site.

3 – Proof


The data recorded by Intellectica constitute proof of all the transactions passed by Intellectica and its clients.

4 – Offer and price


All the articles proposed on the site www.intellectica.org are described in good faith and as accurately as possible.
The offers and price are valid on the day the site is consulted; they can be modified without prior warning.
The prices proposed after the order process is completed are global prices.
Prices are announced in Euros. 

5 – Billing 


For every purchase completed, the internaut receives an Intellectica invoice by email.

6 – Payment


Orders for access to articles which are made via the Intellectica website can only be paid by credit cards via a secure server. A request for authorization will be requested, at the time of placing the order, from your financial organism.

7 - Right of retraction


As provided for by the article L 121-20-2 L of the Code of consumption, the right of retraction cannot be exercised for the right of access to a digital version, the latter being performed by the sending of links for downloading by email or consultation which correspond to definite delivery.


Purchase of right of access to an issue

8 – Cost of sending paper version of an issue 

When the purchaser chooses the option « paper format » in addition to right of digital access, the cost of sending that may eventually be incurred are communicated, on line, at the time of the order.
The costs of delivery are born by the purchaser and are added, in the invoice, to the price of the product(s) ordered.

If Intellectica, for reasons of availability, send the delivery in several installments, the contribution to the costs of treatment and delivery will be billed as for a single delivery.

In case of a shipment to a country outside the European Union, the purchaser is the importer of the products in question. Custom duties, other local taxes or import duties may be required. Such duties and taxes are not the concern of Intellectica. They are payable by the purchaser and are his sole responsibility both in terms of declarations and of payments to the competent authorities. 

 

9 – Time delay for delivery of volumes in paper format 

Intellectica will take care that the order is treated with minimum delay. Intellectica cannot however be held responsible for possible delays in the treatment of order or in their delivery.
Products are delivered to the address indicated by the client and the time of passing the order.
In the case where the order is not fulfilled with a time limit of 30 working days after confirmation, it is possible for purchaser to cancel, without indemnities, by requesting the cancellation by email or registered post.
Any sums that the purchaser has paid will be refunded within 30 days of reception of the request for cancellation.

The time limits indicated correspond to averages and correspond to the time limits for treatment and delivery of products in France.
 

10– Availability of paper format 

The offers and prices of Intellectica are valid insofar as they are visible on the site, on condition of availability.
In the case that an article is not available, the purchaser is informed in the shortest delay by email or letter.
The purchaser informed of the non-availability of an article can cancel their order.
In any case, Intellectica cannot be held responsible for any damages resulting from the non-availability of a paper version.
 

11– Damages and losses (for paper versions)

If the product received does not correspond to what the buyer ordered or if it is damaged, it is possible for the buyer to return it to Intellectica, within a period of seven days after reception. Intellectica will exchange the product within a period of thirty days after reception of the returned article. Intellectica nevertheless reserves the right to refuse the returned products if they have been damaged by the buyer.
If an ordered product does not reach the buyer within a period of twenty days after confirmation of the order, at the address indicated, it is up to the buyer to enter into communication with Intellectica, within a reasonable period, in order to confirm the status of his order.

If it should turn out that the product sent has been lost during the process of delivery, Intellectica will proceed to another delivery, or will reimburse the amount of the order (including the cost of the initial delivery).

Purchase of a subscription to the journal

Every purchase of a subscription to the journal and to downloading the digital version made via the site www.intellectica.org is considered definitive when the user has passed all the steps and confirmed their order.

 

2 – Execution of an order 

At the moment of their publication, Intellectica undertakes to provide immediate access to the issues for which the user had an access during the duration of their subscription. The right to consult the online version of an article or an issue is accompanied by the right to download a PDF version.

The user should note that Intellectica cannot be held responsible for any damage or for any temporary or permanent incident that may be caused to the data or digital material of the client during downloading of files from the site www.intellectica.org. In particular, Intellectica is not responsible for the eventual transmission of viruses by means of its site.

The subscription to a paper version of Intellectica correspond to the sending of two issues published or under publication during the civil year corresponding the duration of the subscription. The issues published previously are only available under a paper format with a single purchase order.

In case of a subscription to a paper version, the internaut can make a reclamation for the non-reception of an issue within 20 days or at least two months after the day of publication of the issue (the day is available on the website).

 

9– Cost of sending paper version of an issue 

When the purchaser chooses the option « paper format » in addition to right of digital access, the cost of sending that may eventually be incurred are communicated, on line, at the time of the order.

11- Right of retraction

As foreseen by the article L 121-20-2 of the code of consumption, the right to retract the order cannot be exercised 

  • for the sale of an issue or a subscription of a paper copy of the journal.
  • for the right of access to a digital version, the latter being effected by sending the downloading links or consultation having value of final delivery.

Whatever the mode of payment chosen, a current subscription cannot be the object of reimbursement, total or partial, requested by the client for purely personal reasons.
 

General disposition for every type of order

1 – Proof

Notwithstanding other written proofs or all proofs kept on a durable medium to which the consumer has access, it is understood that digital registers, kept in the digital systems of Intellectica or its host, can serve as proof of communications and the content of orders between the parties (RGPD, 27/04/2016, art.18).

 

2 – Intellectual rights

The content of this site is protected by authors’ rights. Copying, translating, modifying or circulating all or part of the site, in whatever form, is forbidden, except for prior authorization by Intellectica. This is notably the case for texts, comments, works, illustrations, maps and images present on the site, even if these are proposed free of charge. Any infraction of such intellectual property rights can give rise to civil and penal sanctions..

 

3 – Languages

Intellectica proposes the procedure for on-line orders in French and in English. 

 

4 – Security

Payment by credit card on the CAIRN SA site is made secure by encrypting via the SSL system.

 

5 -  Protection of personal data 

Intellectica collects personal data concerning the client, a user consulting the site, or the consignee of an order. This data collection is performed in particular: 

  • For the creation of an account
  • For an order
  • For subscription to the newsletter

The data collected are destined for use by Intellectica. They are necessary for the treatment and management of clients’ orders as well as for commercial relations between Intellectica and the client.

Intellectica is responsible for the treatment of these data. In conformity with the RGPD (Règlement Général sur la Protection des Données, 27/04/2016), the user has a right of access (art.15), of rectification (art.16), of modification, of opposition (art.21) and of suppression (art.17) of data concerning them; thiese rights are exercised by contacting Intellectica by email or post. These data are kept for 2 years, unless the client gives consent for prolonging the duration of their account (art.18).
